Kristen Maxwell, 29, tragically fell to her death when in a drunken state she mistakenly entered the wrong room and in the state of panic tried to leave the room through the balcony.

Kristen Maxwell, 29, died after she fell off from the balcony of the Apartments Payma at Benidorm, Spain. Mrs. Maxwell was staying on another floor with her girlfriends and in her drunken state is said to have mistakenly entered the wrong room, which was rented by five British men.
According to her family’s lawyer Luis Miguel Zumaquero, Mrs. Maxwell was desperate as she feared sexual assault and felt she had no choice but to jump off from the room's balcony in a state of terror. However, the occupants of the Benidorm room have denied any role in Mrs. Maxwell's unfortunate death and claimed her to be "mad, drunk or drugged.”

The investigation report submitted by the Spanish police suggests that Mrs. Maxwell's main cause of the accident was too much consumption of alcohol which led to her death. However, Mr. Maxwell does not appear to be satisfied with the police report and has dismissed the idea of his wife being suicidal or was high on drugs and said, "Something dark happened in that room and I won’t rest until I know the truth. Kirsty was happy, healthy and had everything to live for. It is crazy to suggest she killed herself."
The police reports states, Mrs. Maxwell had a blood alcohol concentration of 2.79 grams per liter, putting her more than five and a half times over the Spanish drink-drive limit.

According to the police, a new witness has also given them detailed insight into the incident and this witness has suggested that he got the impression that someone was trying to climb from the balcony to get to the floor below. The witness also took snapshots of that situation and claims that at the time of incidence the police were also present.

In the aftermath of the tragedy, the police have investigated the five British men who were residing in the apartment from where Mrs. Maxwell fell from the balcony. The reports have suggested that cocaine was found from their room and one of them Joseph Graham, 32, was quizzed by police in the immediately while the other four flew to Benidorm this week for a court hearing. Ricky Gammon, 31, Anthony Holehouse, 34, Callum Northridge, 27, and Daniel Bailey, 32, all from the Nottingham area, were questioned at Benidorm's Palace of Justice on Thursday and await to hear if they face any further legal action.
Out of the five men being investigated, Mr. Graham has already been allowed to go back to Britain without any charges, after his court appearance on May 1.

All the five occupants of the apartment have strenuously denied any involvement in the tragic incident and have claimed that even though they are innocent and the opinion of the judge is the same that it was an accident, their names had been dragged through the mud.
According to the judge, there were no defensive injuries on Mrs. Maxwell's body except for those that were caused by the fall.

Meanwhile, Mrs. Maxwell's husband and the grieving family does not seem to accept the court verdict and has made heartfelt appeal during the court hearing, asking for the witnesses to come forward and help the estranged family.
Mrs. Maxwell's husband, Adam Maxwell also returned to Benidorm last month to distribute posters and flyers about his wife's death and asking for help from the witnesses to come forward, particularly anyone who was in another high-rise directly opposite the Apartments Payma.
