Amber Heard lost the trial against Johny Depp at the start of this year in a sweeping defamation case where she had been ordered to pay $10million award to ex-husband Johnny Depp. Now the actress's legal team has again come into the spotlight for asking the courts for a reversal of the decision.
Amber Heard's Legal Team Files An Appeal To The Courts Asking For An Entirely New Trial in the Sweeping Defamation Case
Amber's legal team has filed an appeal to the courts for a reversal of the decision
Whoever thought Johnny Depp and Amber Heard's case has come to an end might be wrong as the actress recently has filed an appeal to the Virginia courts asking for a reversal of the decision.
Amber, 36, has asked the court for an entirely new trial in the sweeping defamation case against her ex-husband Johnny Depp, which she lost at the start of this year.
According to Amber, some of her therapy notes, in which she reported being abused by Depp, were not included in the evidence which was the reason the trial ended up unfairly. However, the notes were ruled out by Virginia Judge Penney Azcarate.
In the first half of this year, Johnny Depp, 56, was awarded $10.35million in a verdict delivered after his lawyers successfully managed to win the case where Amber accused him of domestic abuse.
Heard did not name Depp publicly in the piece but given their status and notoriety, it was evident who she was referencing in regard to her history of being allegedly abused.
Heard's legal team has again come into the spotlight for writing that the court 'improperly prevented the jury from considering several instances in which Heard reported Depp's abuse to a medical professional.'
'If not reversed, the trial court’s exclusion of contemporaneous reports of domestic abuse to medical professionals will make it more difficult for other abuse victims to prove allegations of abuse, and likely deter them from coming forward,' they continued.
'That holding, if allowed to stand, undoubtedly will have a chilling effect on other women who wish to speak about abuse involving powerful men.'
'This case also should never have gone to trial because another court had already concluded that Depp abused Heard on multiple occasions,' wrote Heard's lawyers, referring to the United Kingdom High Court of Justice's ruling in a separate defamation suit brought by Depp that the Pirates of the Caribbean actor had abused his ex-wife.
Keep in mind, Heard has a different set of lawyers as her legal team now than those who represented her during the trial.
Heard's legal team argues that the trail should have taken place in California instead of Fairfax, Virginia as the ex-couple spent their married life there.
The legal team says Virginia was an 'entirely inconvenient forum with no connection to Depp or any meaningful connection to his claims.'
On the other hand, Depp's legal is also not taking it slow and claims that the singular count of defamation against Heard of which he was convicted was 'erroneous.'
'The jury’s emphatic favorable verdict on all three defamatory statements alleged in his complaint fully vindicated Mr. Depp and restored his reputation,' wrote Depp's attorneys in their filing.
A group of judges will be looking into both the appeals put forward by the respected legals teams. If, incase, they do not agree with the decision, Depp or Heard can then take the matter to the state's Supreme Court. Let's see what the court has to say on this.
