Johnny Depp and Amber Heard's defamation trial has resumed after 10-day hiatus and now the court has confirmed that Amber Heard's picture of the bloody lip will not be submitted as evidence.

The Aquaman star, 36, claims a particular incident of physical assault - that she says was instigated by Depp - left her with a bloody lip.

According to TMZ, the jury decided that the image will not be used in court as evidence because it was not submitted in time for the explosive $50 million trial.

Taking the stand earlier this month, Heard told the court that Depp hit her in the mouth during a heated row, saying: "I was in one of these fights, I believe it's this one, in his downtown ECB, we call it, loft, and we're in the kitchen living room area and he backhands me."

She continued: "And, you know, it was, you know, he wears a lot of rings. I remember kind of just feeling like my lip went into my teeth, and it got a little blood on the wall. Just that simple, a little bit of blood on the wall."

Heard claims she took the photo after the incident. It also shows her holding a piece of paper that reads: "I shall return xxx". The Rum Diary actress says Depp had left the note behind after the altercation.

Depp's legal counsel objected to the photo being shown in court, arguing that the actress' own legal team did not submit the picture in the discovery phase of the high-profile case.

Eventually, the court agreed with Depp's lawyers, and thus, the picture was prohibited from being included as evidence in support of Heard's claim that she was a victim of domestic violence by her former husband.

Depp's counsel has since alleged to TMZ that the photo doesn't support the dates specified by Heard in her allegations against the actor.

According to TMZ, Depp's legal team claims that the picture is from 2012, however, in the Fantastic Beasts star's libel trial against UK tabloid The Sun, Heard's witness statement alleges that the very first violent outburst happened the following year.

In fact, one source close to Heard also revealed that the Aquaman actress had mixed up the exact dates in the previous libel trial, but her therapist records supposedly show that the alleged violence started around early 2012.
