Amber Heard only stayed in Aquaman 2 because Jason Momoa was "adamant" about it.
The jury in Depp's defamation trial heard that Amber Heard only stayed in Aquaman because its star, Jason Momoa, and the film's director fought for her.
Witness Heard Kathryn Arnold assessed Depp's claims for damages as a result of Heard's op-ed and Heard's claim for damages based on Depp's lawyer's comments that her allegations were a "hoax."
According to Arnold, Aquaman was Heard's "a star is born moment," but she was nearly cut from the sequel instead of launching her career.
Heard only kept her role because her co-star Jason Momoa and the film's director James Wan 'committed to her' and were 'adamant she was in the film,' according to Arnold, who spoke with Heard in preparation for her testimony.
According to Arnold, her character Mera had a "strong romantic arc throughout the film and some great action sequences" in the first draught of Aquaman 2.
Depp's fans started a "negative social media campaign" against Waldman, using her words as hashtags.
A petition to have Heard removed from Aquaman 2 received over 4 million signatures.
On Monday, during the Depp v Heard defamation lawsuit trial at the Fairfax County Circuit Courthouse in Fairfax, Virginia, Johnny Depp carried his notebook and phone.
The final arguments are scheduled for later this week.
Depp's legal team questioned industry consultant Kathryn Arnold about why she compared Amber Heard's career to big stars like Jason Momoa and Gal Gadot during cross-examination after the Monday afternoon break.
'She's never been the title character in a movie,' he said. 'She wasn't on TV for years.'
'For the jury to accept your damage analysis, they would have to agree with you that Heard was on the precipice of a meteoric rise,' he pointed out.
According to Kathryn Arnold, Amber Heard's career rose before Depp's former lawyer Adam Waldman's 'defamatory' statements in 2020.
Waldman said heard made false abuse allegations against Depp and staged the 'abuse hoax.'
According to Arnold, Heard's career was put on hold after she received negative feedback on social media.
She compared Heard's career to similar actors such as Jason Momoa, Zendaya, Chris Pine, and Ana de Armas, claiming that hers should have followed the same timeline.
Arnold said they all had a 'meteoric' rise after their 'star is born' moment and got lucrative endorsement deals and massive paychecks.
'It would have been very reasonable to believe her career would have been on an upward trajectory.'
Arnold said Heard was set to be on the cover of LA Style following her role on the Stephen King mii-series 'The Stand,' but was taken away following the 'Depp-Waldman statements.'
She said Heard made $200,000 per episode on 'The Stand', and the fee would likely have gone up from there with her agents using the leverage of the success of Aquaman.
Arnold testified in court on Monday that Depp's career was already in decline before Amber Heard's op-ed piece in the Washington Post.
Because 'Pirates 6' had not yet been made, Arnold said Heard's op-ed had no bearing on Depp's role.
'Mr. Depp is claiming that he lost money on 'Pirates 6,' but 'Pirates 6' hasn't even made yet,' Arnold said. 'So, I don't know how you lose something that hasn't happened.'
She said Depp had an 'extraordinary' career but had a series of 'bombs' before 'Pirates 5' that were not very successful at the box office.
These films included 'Mortdecai' (2015), 'Alice Through the Looking Glass' (2016) and 'The Lone Ranger' (2013).
She added that Depp's character Jack Sparrow had been 'exhausted in terms of where it could go creatively' and there were also concerns about his behavior.
'It was difficult for the industry to work with him,' she said.
'Well, we talked about the erratic behavior, the tardiness, the drugs, and alcohol abuse,' Arnold added. 'And the lawsuits have had a big impact, not just this lawsuit but previous lawsuits that Mr. Depp has been involved with because there's a lot of publicity around anything he does.'
She added: 'It's hard for studios, especially a studio like Disney, who's family-oriented, to be connected to a star that has texts about burnt corpses and violent behavior in the video.'
An expert witness from the entertainment industry: According to Kathryn Arnold, there were doubts about whether Heard would be retained for the sequel to Aquaman.
She said her first film was her "star is born" moment, but the negative publicity harmed her career.
Heard testified that she was set to earn $2 million for Aquaman 2, but Warner Bros. decided to reduce her role due to a "lack of chemistry" between Heard and Aquaman star Jason Momoa.
Elaine Bredehoft, Heard's lawyer, has called Kathryn Arnold, an entertainment industry consultant and expert with over 20 years in the business, to the stand.
A source close to Heard's legal team told NBC News that Johnny Depp will not be testifying on Wednesday.
According to the source, Depp's testimony has been "irrelevant to the heart of this case" and is unlikely to change.
Depp's team may call him back to the stand later this week to question rebuttal witnesses before closing arguments.
A woman with a baby yelled out that the child belonged to Johnny as the court was dismissed for the morning break on Monday. She was quickly led out of the courtroom.
The woman in the gallery yelled out, 'Johnny, I love you!' according to Angenette Levy of the Law & Crime Network. Our spirits are linked!'
She responded by holding up the baby and shouting, 'This baby is yours!' as Johnny has done with many of his supporters.
The woman's wristband was severed from her arm, and she was escorted out of the courtroom.
During cross examination before lunch break, Dr. Spiegel testified that he read about Depp using earpieces on movie sets.
He had previously explained the cognitive impact of severe substance abuse, including memory loss and difficulty concentrating.
Citing a report he read, he gave the example of Depp being fed lines through an earpiece when acting.
Depp's lawyer Wayne Dennison asked Dr. Spiegel about actors' use of earpieces.
'I don't believe that actors are routinely given their entire script through earpieces," Spiegel said. 'I find that hard to believe.'
'Do you know whether Marlon Brando used an earpiece?' Depp's attorney asked Spiegel.
'Isn't he dead,' Dr. Spiegel asked. When the lawyer responds that he is, the doctor responds: 'The answer is no, well, he does not use one now.'
'I know nothing about acting,' Spiegel admitted. 'If that's the standard, I am wrong, I don't know.'
Depp covers his face with his hands and shakes his head.
'I don't want to talk about all of them, but ... in particular are: one, having someone in the relationship who is jealous or suspicious,' he said. 'Two, having someone who has a higher than average acceptance of violence ideations. Three, someone who has rapid and extreme mood shifts. Four, someone who has limited self-control.'
Heard's attorney Elaine Bredehoft asked if there was evidence of Depp with these warning signs, Spiegel said it was almost 'routine.'
'You start seeing partners getting angry, breaking down the communication, and engaging in verbal, non-verbal threats,' he explained.
He also explained that narcissism can be related to IPV, describing narcissists as having poor self-control, rapid mood shifts, envious, and worshipping power and control.
There are 'calm' phases' and it's common for the individuals to blame the victim, he added.
Kate Moss, 48, will take the stand on Wednesday, the New York Post reported. She will testify via video link.
The model was in a relationship with Depp between 1994 and 1997.
Amber Heard brought up Moss during her testimony last week, saying she had heard a rumor that Depp pushed the model down a flight of stairs.
'Amber mentioned an ex of Johnny's that clearly she felt was not supportive of him, which couldn't be further from the truth,' a source close to Depp told The Post.
Dr. Richard Moore testified that he looked over photos, medical records, and Depp's testimony.
For the jury, graphic images of Depp's finger were shown.
While they were fighting in Australia in 2015, Depp testified that Heard severed his finger by throwing vodka bottles at him.
However, the doctor stated that the medical evidence is inconclusive.
'It's not consistent with what we see in the described injury pattern... the description was the hand being flat on the bar and the bottle crushing the finger from the top. But looking at the images, there's really no significant injury to the dorsal of the finger and created the type of injury ... we would anticipate both injury to the fingernail and other parts of the finger.'
The doctor said the injury looks more consistent with the finger being squeezed between two hard surfaces similar to between sliding glass doors.
Today, Johnny Depp is set to testify in a blockbuster conclusion to his $50 million defamation suit with ex-wife Amber Heard, which has already produced a slew of explosive revelations.
The Pirates of the Caribbean star, who last took the stand two weeks ago, is expected to be called again as a rebuttal witness by Heard's lawyers as the trial enters its seventh and final week.
There are conflicting reports about when the 58-year-old actor will testify, with some claiming it could be today.
