Netflix Loses Court Battle Over Raising Prices The Past 7 Years And Is Ordered To Pay Refunds

An Italian court has ruled against Netflix, ordering the company to pay back subscription fees after deciding that several price increases broke consumer protection laws.

Over the years between 2017 and January 2024, Netflix gradually raised its subscription prices. However, Italian consumer group Movimento Consumatori challenged those changes in court, arguing that they did not meet legal standards.

The court agreed with that argument and ruled in favor of consumers. As a result, Netflix has now been instructed to refund customers who were affected by those increases.

Some customers could now receive significant refunds. Premium plan users may be entitled to as much as $576, while Standard plan subscribers could receive around $288, based on reports from Reuters.

Netflix has responded by saying it plans to appeal the ruling. The company believes its pricing terms were valid and consistent with Italian law.

Lawyers Paolo Fiorio and Riccardo Pinna, who represented the consumers in the case, explained the breakdown of the increases, stating: "For the Premium Plan, the unlawful increases applied in 2017, 2019, 2021 and 2024 amount to 8 euros ($9.22) a month, while for the Standard Plan the total is 4 euros a month."

"A Premium subscriber who has paid for Netflix continuously from 2017 to the present day is entitled to a refund of about 500 euros, while a Standard subscriber is due a refund of about 250 euros."

Alongside ordering refunds, the court in Rome also instructed Netflix to publicly share the ruling. This includes publishing it on its Italian website and in major national newspapers across the country.

The goal of this requirement is to make sure customers clearly understand that the price increase clauses were invalid. It also informs them that they have the right to request reimbursement for the extra amounts they paid.

So what exactly led the court to decide that Netflix had broken the rules with these price changes?

The key issue came down to how the increases were applied. The court found that Netflix allowed price changes without clearly stating a valid reason in its contracts.

This lack of transparency became a central point in the ruling and raised concerns about fairness for subscribers.

According to the court, the pricing changes were considered unfair because customers were not given proper justification for the increases within the contract terms.

This was found to be in violation of Italy’s National Consumer Code, which requires clear and fair conditions when altering subscription agreements.

In addition to refunds, the ruling also opens the door for possible compensation in certain cases. It further states that current subscribers could be entitled to reduced pricing going forward.

In response, Netflix issued a statement defending its position, saying: "We take consumer rights very seriously and believe our terms have always complied with Italian laws and practice."

Despite the legal setback, Netflix remains one of the largest and most widely used streaming platforms in the world, offering a vast library of films and television shows to millions of users globally.
