School District Faces A Lawsuit From A Mother After A Teacher Accidentally Sends A Voice Mail Mocking Her Special Needs Daughter

A mother of a child with learning disabilities claims that her daughter was mocked by the teachers at school for her disability. The woman claims that she received accidentally recorded voice mail and to her horror, she was shocked that the teachers were repeatedly insulting her child's ability and appearance.

It is reported that in February 2015, Beth Suhon received a call from one of her daughter's teachers telling her that her daughter was struggling at school. But the teacher mistakenly forgot to cut the call off and to Suhoon's utmost horror she received a voice mail in which three of her daughter's teachers could be heard in the background making fun of her daughter's abilities.

According to the heartbroken mother, one of the teachers said that her daughter has 'no strengths' while the other teacher laughingly suggests that 'she could be a good coal miner.'

The unfortunate point here is that the heartless teachers were making fun of not only an innocent child but also someone who is mentally challenged. According to Suhon, her daughter was diagnosed with Turner's syndrome in her first grade. This is a genetic disorder in women which causes developmental problems and learning disabilities.

Along with this Suhon's daughter also suffers from severe anxiety and obsessive-compulsive disorder.

The mother is now suing the McGuffey School District accusing the school of improperly terminating the girl’s special-needs teaching plan and retaliating against her and her family when they complained. The filed suit is seeking damages against the school district for the violation of various Americans with Disabilities Act and the Civil Rights Act.

Suhon states that a special teaching plan was made for her daughter in her third grade but was terminated within a year without the district informing the parents.

The distressed mother says, "It was very difficult for me to tell my child, who has been bullied by her peers for years, that she was now being bullied by her teachers. Adults can be bullies, too."

According to the report by the attorney Michael McElligott, "the comments in the voice mail were nearly unfathomable, and frankly heart-breaking." The report submitted by the special education officer states, "The educators mock the students' mathematics ability, physical appearance, and classroom behaviour, punctuating these crass comments with derisive laughter."

The lawsuit is proceeding in all of the cases and is seeking compensation for all the damages. The school district, however, has not yet commented on the lawsuit.
